ENSURING AND PROTECTING THE RIGHTS OF CITIZENS-PARTICIPANTS OF SHARE-BUILDING UNDER THE INSOLABILITY (BANKRUPTCY) OF THE DEVELOPER

The article analyzes the legal status of a citizen participating in shared housing con- struction in the event of insolvency (bankruptcy) of the developer and ways to protect his rights. The concepts of “developer”, the registry of creditors are investigated. The advantages of lenders - interest holders are considered. The legal mechanism for trans- ferring construction in progress to new investors is being studied. The requirements for the acquirer are examined. The mechanism of the functioning of the Fund for the Protection of the Rights of Citizens-Participants in Shared Construction and Escrow Accounts is analyzed. The mechanism of establishing and compensating losses incurred by citizens due to the incomplete construction of an apartment building is considered. The process of reimbursing funds to citizens participating in shared housing construction is considered if the developer is declared insolvent (bankrupt).
