GENERAL CHARACTERISTIC OF THE SURROGATE MOTHERHIP AGREEMENT

This article is devoted to the general characteristics of the surrogacy agreement. The theoretical and practical problems associated with the determination of its legal nature are revealed. Much attention is paid to the subject of the surrogacy contract and to the analysis of the content of the contract. Its essential conditions are determined, including the rights and obligations of a surrogate mother, as well as genetic parents. The legal status of other subjects of the contract is investigated. The grounds for termination of the obligations of the parties under the contract are considered. Attention is drawn to the need to improve the legal regulation of the surrogate motherhood agreement, given the fact that the ultimate goal of its conclusion is the birth of a child and the emergence of legal relations for his upbringing.
