CRIMINOLOGICAL CHARACTERISTICS OF CRIMES PROVIDED FOR BY ARTICLE 264.1 OF THE RUSSIAN CRIMINAL CODE: THE REGIONAL ASPECTS

The paper deals with the criminological characteristics of the crimes provided for in Art. 264.1 of the Russian Criminal Code “The Traffic Offence Committed by a Per- son Subjected to Administrative Punishment”. The statistical data on acts provided for by Art. 264.1 of the Criminal Code for 2018–2020, the results of a sociological survey of road users allow us to analyze the incidence of alcohol abuse among drivers, which lead to grave consequences. Among the causes and conditions of road traffic crimes we emphasize the significant deformation of citizens' legal consciousness and, first of all, irresponsibility. Drunk driven is a highly latent crime, it is not adequately reflected not only in criminal, but also in social statistics. Analysis of criminal law statistics and the information of the Unified State Automated Information System for the municipalities of the Republic of Buryatia revealed the correlation between the largest sales of alcohol and the number of recorded “drunken” crimes, including road traffic. We also reveal some features of this criminal law, which, in our opinion, is not completely aimed at establishing administrative prejudice.
