LABOUR RIGHTS UNDER THE CONSTITUTION OF THE REPUBLIC OF BURYATIA

According to the provisions of Article 72 of the Constitution of the Russian Federation, the joint jurisdiction of the Russian Federation and its constituent entities includes the powers to adopt laws and regulations containing employment and labour statutes on issues that are not within the jurisdiction of federal authority. Labour rights are some of the most important constitutional human and civil rights, which are enshrined in Article 37 of the Constitution of the Russian Federation and in the Constitution of the Republic of Buryatia. The issues relating to the labour rights of citizens along with the constitutional guarantees of such rights play an important role in the legal regulation of the labour relations. The ongoing studies of the constitutional human and citizen’s rights in the labour sphere contribute to the improvement of the current labour legislation, which is dynamically developing. The article analyzes the constitutional provisions of the republican level, containing the fundamental principles of labour law and the citizens’ rights in the field of labour. We have reflected the compliance of their content with the regulations of the Constitution of the Russian Federation, as well as with the provisions of international law acts, which enshrine among other things the concept of decent work. The article gives a brief description of the citizens' rights enshrined at the constitutional level in the sphere of labour and wage security, and considers the implementation of constitutional provisions in the normative legal acts of the republican level.
