ON SOME ISSUES OF LEGAL RESPONSIBILITY IN THE ELECTORAL PROCESS

The article deals with the issues of legal regulation of exposure of the participants of the electoral process to legal liability on the example of illegal issuance and illegal receipt of ballots. We emphasize that the existing mechanisms of legal liability are proven by law enforcement practice, however, the development of relations in the field of the electoral process and the new technologies used in it entail the need for further improvement of the regulations on the responsibility of subjects of the electoral process. One of the key issues discussed in the article is the problem of delimiting the types of legal liability (primarily criminal and administrative) in relation to specific types of offenses in the field of the electoral process. Based on the analysis of regulations of the current legislation, we have given the examples from the practice of holding elections in the Russian Federation, made proposals to improve the regulation of legal responsibility for these offenses.
