OBSTACLES IN IDENTIFYING AND RESOLVING A CONFLICT OF INTEREST IN THE STATE CIVIL SERVICE AND MUNICIPAL SERVICE

The article considers the provisions that reveal the features of the obstacles in identifying and resolving conflicts of interest in the state and municipal service. The conflict of interest is studied in the context of corruption mechanisms in the state and municipal service. We have analyzed the main causes and conditions that give rise to a conflict of interest in the state civil service and municipal service, as well as the legal regulation related to the conflict of interest, including the National Anti-Corruption Plan for 2021–2024, approved by the Decree of the President of the Russian Federation of August 16, 2021 No. 478.
The article presents data on law enforcement and judicial practice regarding the conflict of interest in the state (municipal) service on the example of the Republic of Buryatia. We come to the conclusion about the complex structure of the legal definition of «conflict of interest», draw attention to the need to modernize the organizational and legal mechanism for overcoming conflicts of interest in the state and municipal service, and therefore provide some improvement measures to resolve conflicts of interest in the state and municipal service.
