ANALYSIS OF THE CURRENT PROBLEMS OF IMPLEMENTING CRIMINAL PROCEDURAL GUARANTEES THAT ENSURE PERSONAL LEGAL STATUS WHEN THE COURT APPLYS VIDEO TECHNOLOGY IN CRIMINAL PROCEEDINGS

Based on formal legal analysis, we have identified the current problems of imple- menting criminal procedural guarantees that ensure personal legal status when the court applys video technologies in criminal proceedings. It is emphasized that despite the fact that the Russian Federation has ratified the European Convention and thereby assumed the obligation to bring domestic legislation into compliance with its legal provisions, at present there is no an effective mechanism for guaranteeing the implementation of the standards provided for by the European Convention in the domestic enforcement practices of using video conferencing. So, there is a need to create an effective mechanism of criminal procedural guarantees that will ensure the implementation of personal legal status, as well as the reliability of information when the court applys video technologies in criminal proceedings.
