The article deals with the issues within the scope of the personal law of individuals under the Russian and foreign international private law. An analysis of the current Russian and foreign legislation and doctrine shows that the scope of the personal law of individuals in the Russian Federation and abroad traditionally includes the issues of passive and active legal capacity, property and non-property marriage and family relations, custody and guardianship, adoption, inheritance of movable property. However, we should note that not all scientists justify the legislator’s appeal to the personal law of individuals in resolving conflict issues of legal capacity. In some foreign countries interest of the state in regulating certain issues relating to the legal status of foreign citizens is weakening, as a result it becomes possible to discuss them under the law on citizenship of individuals.
