ABOUT THE TERMS OF THE MORTGAGE AGREEMENT (PLEDGE OF REAL ESTATE)

The article discusses the nuances of the institution of real estate mortgages, as currently mortgages are the most attractive type of collateral, which is used as a way to ensure various monetary obligations. This is due, first of all, to the fact that the real estate ob- jects in respect of which the mortgage is established, as a rule, have a high cost and liquidity, which prompts the debtor for the monetary obligation to fulfill it properly, under the threat of loss of property, while being a special guarantee for the lender even in case of non-fulfillment or improper fulfillment of this obligation to receive money due to him. The author analyzed the form of the mortgage agreement, the mortgage, identified some legislative gaps, suggested options for addressing them.
