Annotation:
The article examines some of the problems of land acquisition for state and municipal needs. In particular, it reveals the problem of the ambiguous interpretation of
«state needs» in the Constitution of the Russian Federation, the lack of a single concept of «state and municipal needs» and the methodology for determining the market price and amount of damage, as well as the problem of an open list of grounds for the seizure of land for state and municipal needs. The ways of solving these problems by creating a single normative legal act containing the definition of «state and municipal needs», a methodology for determining the price and damage are proposed.
