Annotation:
This article examines the grounds of the suspended sentencing (or probation as a part of it) application and practice under the criminal laws in Russian Federation and Mon- golian People’s Republic. The materials of the research were the Criminal Codes of the Russian Federation (further UK RF) and Mongolia, previous scientific works and stud- ies in the criminal law field, publications reflected in journals highlighting the prob- lems of the use of suspended sentencing (probation), data posted on e-resources, mate- rials of judicial practice focused on this topic. Highlighted the problematic issues of law enforcement; studied the existing grounds for the application of suspended sentenc- ing (probation) under the Criminal Laws of Russia and Mongolia; analyzed the judicial practice of the use of suspended sentence (probation). The analysis of suspended sen- tencing (probation) application allowed to formulate the effectiveness of this measure of criminal law and the shortcomings of its enforcement.
