TRENDS AND PROSPECTS FOR THE DEVELOPMENT OF DIGITAL CRIMINAL PROCEEDINGS

The article provides a formal legal analysis of the legal foundations and practices of the introduction of modern video technologies in criminal proceedings. Certain features of video technologies widely used in the practice of courts are revealed, as well as legal conditions that serve as a guarantee of the legality of their application are formulated. Atten- tion is drawn to the decisions of the European Court of Human Rights reflecting the stand- ards for the use of video technologies in criminal proceedings. It is emphasized that modern digital technologies are practically not used in domestic criminal proceedings, but the pre- requisites for their widespread use are actively being formed under the influence of digitali- zation. It is noted that the active introduction of digital technologies into the criminal pro- cess is possible only if an effective mechanism for the protection of individual rights in criminal proceedings and fair trial standards are formed.
