Annotation:
The article analyzes the problems of presenting electronic evidence, which
have become widespread in the judicial process in light of informatisation of society.
We have analyzed the role of a notary in providing digital evidence. Russian legislation
does not regulate the introduction of digital evidence in court. Moreover, such regulations are at the initial stage of digital evidence acceptance.
According to the Arbitration Procedure Code, digital documents are classified as
written evidence. Moreover, digital documents meet the requirements of written evidence. Thus, a notary helps organize and certify digital documents in the appropriate
form. Electronic evidence is provided by a notarial protocol, a protocol of examination
of an electronic message by court, and also by using an expert opinion.
