Annotation:
The article analyzes the experience of using the “smart court” system in the PRC, assesses the pros and cons of justice digitalization based on law enforcement practice. The study is based on the scientific works of Chinese scientists, expert opinions, analysis of the Chinese legislation, as well as on the recommendations of the Supreme Court of the PRC. In particular, the article focuses on the history of smart court’s development and its introduction into the Chinese system of justice, assessment of direct participants in legal proceedings using artificial intelligence systems, as well as on the statistical indicators of the effectiveness of their implementing (reducing the workload of judges, increasing the accessibility and comprehensibility of judicial protection for citizens, etc.). In addition, we give a brief description of the technical functionality of a “smart court”, which involves the systematization of evidence, keeping records of court hearings, combining several cases into one, etc. We have paid special attention to assessing the prospects for the use of “smart court” technologies in Russia taking into account the similarities and differences in the requirements of legislation in the two countries.
